Scope and purposes of collection of data

In case you are visiting our website, we will collect the following data:

  • URL of the website accessed by the visitor;
  • the website the visitor is referring from (referrer-URL);
  • the used browser and operating system as well as the name of the access provider;

  • to guarantee a comfortable use of the website by visitors;
  • to analyse the security and stability of the system; and
  • to administrate the website.

We are processing these data in accordance with Art. 6 para 1 sentence 1 lit. f) GDPR. Our legitimate interest results from the above purposes of processing.

The collected data will be erased after the visit of our website unless we are subject to a legal retention obligation (e.g. for telecommunications data retention) or you have given your explicit consent to retain your data. In case we retain your data because of a legal retention obligation, the data will be erased once the retention period has expired.

Transmission of Data

We will generally not transmit the data collected upon your visit of our website to third parties. We will, in exceptional cases, transmit data to third parties in case one of the following applies:

Contact Form

In case you contact us via the contact form, we will collect the data entered on the form, including the contact details you provide, to answer your question and any follow-up questions. We do not share this information without your permission.

We will, therefore, process any data you enter onto the contact form only with your consent per Art. 6 para 1 sentence 1 lit. a) GDPR. You may revoke your consent at any time. An informal e-mail making this request to info[at]next-estate.de is sufficient. Such request does not affect the lawfulness of processing activities before the time of receipt of your revocation.

We will retain the data you provide on the contact form until you request its deletion, revoke your consent for its storage, or the purpose for its storage no longer pertains (e.g. after fulfilling your request). Any mandatory statutory provisions, especially those regarding mandatory data retention periods, remain unaffected by this provision.

Use of Cookies

Our website uses cookies. Cookies are small data packets which are exchanged between the visitor’s browser and the server of our website. These packets are stored on the visitor’s terminal device. In these cookies, data is stored which enables our website to recognise your browser on the next visit and automatically use the same settings as of the previous visit. In this context, pseudonymised user profiles will be created and cookies will be used (see above: Use of Cookies). Information produced by the cookie regarding your use of our website, in particular

  • the referrer-URL;
  • the name of the host of the respective terminal device;
  • date and time of the retrieval of the website

will be transmitted to a server of Google located in the United States and stored there. The data will be used to analyse the use of our website, to compile reports regarding the activities on the website and to rend further services related to the use of the website and the internet, for the purposes of market research and personalising of websites. Data is transmitted to third parties to the extent that these third parties are processing the data. IP-addresses will be anonymised, which prevents allocation to a person.

Apart from the possibility to prevent the use cookies in general, (see above: Use of Cookies), you can install a browser add-on to prevent that information created by the cookie as well as data related to your use of our website (e.g.: IP-address) will be collected and processed by Google. Our website uses Facebook Pixel (Pixel) a service of Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, US (Facebook). When you visit our website, Pixel creates a connection between your browser and Facebook’s servers. Your collected data, including your IP-address will be transmitted to and stored in the US.

We as the operator of this website do not know which data is transmitted to Facebook.

Googel Adwords

Our website uses Google AdWords (AdWords), and in the course of its use a conversion-tracking. The Google conversion-tracking is a service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (Google). By clicking on an ad hosted by Google, a cookie (see above: Use of Cookies) for conversion-tracking is set on your terminal device. These cookies are of limited validity, do not contain personal data and therefore do not serve to identify you. When visiting certain sites of our website, and if the cookie did not expire yet, Google and we can see that you have clicked the ad and were directed to this website. Every customer of AdWords gets an own cookie. Therefore, it is not possible to track cookies about websites of AdWords customers

The data collected by using the conversation cookie are used to create conversion statistics. We can hereby analyse the total amount of visitors which clicked one of our ads and were directed to another website. We are not getting any data which could be used to identify a visitor personally.

Facebook Lookalike Audiences

Our website uses the remarketing service Lookalike Audiences (Lookalike), a variation of Facebook Custom Audiences, a service of Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (Facebook).

This function has the purpose to address persons having similar interests on Facebook to visitors of our website.

Facebook’s remarketing was implemented on our website. This tag creates a direct connection between your browser and Facebook’s servers when visiting our website. What sites you were visiting is transmitted to and stored on Facebook’s servers in the US. Facebook will allocate this information to your personal Facebook profile. Facebook will use this to display personalised advertisement to Facebook users with similar interests.

The legal basis of use of the web-analysis tool is Art. 6 para 1 sentence 1 lit. f) GDPR. Our legitimate interest is the extension of our advertisement reach to potentially interested Facebook users.

Newsletter

In case you sign up for our newsletter, we will collect your e-mail-address. Signing up is voluntary. We do only process your data, in this case, by sending our newsletter.

The legal basis for the use of your data is your explicit consent pursuant Art. 6 para 1 sentence 1 lit. a) GDPR. You can withdraw your given consent at any time (please see below: Your Rights as Data Subject).

We will erase your data when you sign off the newsletter, unless we are subject to a legal retention obligation (e.g. for telecommunications data retention), you have given your explicit consent to retain your data, or in case storage of your data is our legitimate interest.

Search Order

When visiting our website, you have the opportunity to save a search order using the form “save search order”. In case you save a search order, we will collect the following data:

  • last name, name;
  • e-mail address;
  • possibly: telephone number.

We will use this data to send you real estate offers matching your search criteria as saved in your search order. We will send offers via e-mail and – in case you explicitly asked for it – via telephone.

We will erase this data once you deactivate the search order, unless we are subject to a legal retention obligation (e.g. for telecommunications data retention), you have given your explicit consent to retain your data, or in case storage of your data is our legitimate interest.

YouTube

Our website uses a function to embed videos of YouTube LLC. 901 Cherry Ave., San Bruno, CA 94066, USA (Youtube).

Youtube is a company affiliated with Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; (Google).

The function displays videos deposited on YouTube in an iFrame on our website. When you watch a video, data is collected and transmitted to and stored at YouTube.

The storage of your IP-address is necessary to use maps. The IP-address will usually be transmitted to and stored on Google’s servers in the US. We cannot influence whether your data is transmitted to Google or not.

Your Rights as Data Subject

With regard to your personal data collected by us, you have the following rights against us:

  • the right to claim access to the processed data pursuant Art. 15 GDPR. In particular, to claim access to: the purposes of processing, the categories of personal data, the categories of recipients to whom the personal data have been or will be disclosed, the envisaged period for which the personal data will be stored, the existence of the right to request from us rectification or erasure of personal data, to object to such processing, where the personal data are not collected from the data subject, any available information as to their source, the existence of automated decision-making, including profiling and, at least in those cases, meaningful information about the logic involved;

  • in case data is processed due to legitimate interests pursuant Art. 6 para 1 lit. f) GDPR, the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you pursuant Art. 21 GDPR. Where personal data is processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing, we will immediately stop the processing activity.
